Terms and Conditions

Last updated: September 29, 2026

These Terms and Conditions govern your purchase and use of Sweet Web website services. By placing an order for a Sweet Web website or continuing to use our services, you agree to these Terms and Conditions.

1. Website Services

Sweet Web provides website design, hosting and related website services according to the package selected by the customer.

The specific features, services and pricing included with your package are those presented to you at the time of purchase. Services or features not included in your selected package may be available for an additional fee.

Sweet Web may use third-party services and providers in delivering certain features of your website, including domain registration, hosting infrastructure, payment processing, email, software, plugins and other technology.

2. Website Completion and Customer Responsibilities

We will make reasonable efforts to complete your website as quickly as possible.

Website completion times may vary depending on the scope of the project, the availability of required information and content, customer response times, revisions, the number of projects currently in our production queue and circumstances beyond our reasonable control.

Customers are responsible for providing requested information, content, approvals and feedback required to complete or maintain their website.

Delays in providing required information, content, approvals or feedback may delay the completion or publication of the website.

If a project remains inactive for an extended period because required information or customer approval has not been provided, Sweet Web may place the project on hold and resume work when the required information becomes available.

Customers are responsible for reviewing their website and providing reasonable notice of errors, omissions or requested corrections before publication or launch.

Once a website has been approved by the customer or made publicly available at the customer's request, Sweet Web may consider the website approved for purposes of the original project scope.

Corrections or changes requested after approval may be subject to the applicable change fees and package limitations.

Any estimated completion date is an estimate and is not a guaranteed deadline.

3. Customer Content and Responsibilities

You are responsible for ensuring that all content you provide to Sweet Web, including text, photographs, graphics, logos, audio, video and other materials, is owned by you or that you have the necessary rights and permissions to use it.

By providing content to Sweet Web for use on your website, you grant Sweet Web a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, publish and display that content as reasonably necessary to provide, maintain and support your website.

You remain responsible for the accuracy and legality of content provided by you.

Unless you request otherwise in writing before publication, you grant Sweet Web permission to display your completed website, business name and logo in Sweet Web's portfolio, website and promotional materials.

4. Website Changes and Updates

For the Simple Website Package, you receive 30 minutes of free website changes each year. The 30 minutes may be used for multiple smaller requests.

Changes requested after the included 30 minutes are billed at $25 per 30 minutes, with a minimum charge of 30 minutes.

Website changes may include text updates, image changes, page changes, layout changes and other modifications to an existing website.

This applies to website changes, updates and other work outside the services included with your selected Sweet Web package. Requests that fall outside the services included with your package may be billed separately.

We will advise you if we expect requested work to require significant additional time before proceeding where reasonably practical.

5. Payment, Taxes and Payment Disputes

Subscription payments are automatically charged to the credit card according to the monthly or annual payment option selected at checkout.

You are responsible for keeping your payment information current.

If a payment cannot be processed, we may attempt to contact you and/or process the payment again.

If payment remains unpaid for 15 days after the payment due date, Sweet Web may suspend the website and related services until the outstanding amount is paid.

Suspension of services does not cancel any payment obligations that have already become due.

Prices are stated in Canadian dollars unless otherwise indicated. Applicable sales taxes and other government charges will be added where required by law.

If you believe a payment was made in error or there is a problem with a charge, please contact Sweet Web so that we can investigate and resolve the issue.

A chargeback or payment dispute does not automatically cancel any payment obligations under these Terms.

Sweet Web reserves the right to suspend services while a disputed payment or outstanding balance is being investigated or remains unpaid.

6. Cancellation

You may request cancellation at any time by contacting Sweet Web by email or phone.

Cancellation will prevent future renewal after any applicable minimum commitment or paid subscription period has been completed.

Cancellation does not automatically entitle you to a refund of payments already made.

7. Refund and Cancellation Policy

Sweet Web subscriptions are intended to provide an ongoing website service and are not offered as a free trial.

Annual Plans

Once website work has begun, the annual subscription payment is non-refundable, except where a refund is required by applicable law.

Domain registration fees and other third-party costs are also non-refundable once incurred, except where required by applicable law.

Monthly Plans

Monthly plans require a minimum commitment of twelve (12) months.

Once website work has begun, payments already made are non-refundable, except where a refund is required by applicable law.

Cancelling your subscription does not cancel any remaining payment obligations required to satisfy the twelve-month minimum commitment.

Your subscription will remain active through the period that has been paid for and will not renew after cancellation.

If you are dissatisfied with your website or need assistance using the service, please contact us. We will make reasonable efforts to address issues and help ensure that your website is functioning substantially as described.

Domain registrations, third-party services and other costs paid on your behalf are non-refundable once incurred, except where required by applicable law.

Nothing in this section limits any cancellation or refund rights that cannot legally be excluded under applicable Ontario or Canadian law.

8. Hosting and Website After Cancellation

Your website will be hosted on Sweet Web's servers for as long as your Sweet Web subscription remains active and payments are up to date.

If your subscription is cancelled or terminated due to non-payment, hosting and related services may be suspended or terminated in accordance with these Terms.

When a Sweet Web subscription is cancelled or terminated, the website and related hosting services will remain available until the end of the period that has been paid for, unless otherwise stated in these Terms.

After the subscription ends, Sweet Web may deactivate the website and remove the website from its hosting systems after a reasonable retention period.

Customers are responsible for requesting and obtaining any content they wish to retain before the subscription ends.

Sweet Web does not guarantee that website files, databases, email accounts, backups or other website-related data will remain available after the subscription has ended.

9. Domain Names

Where a domain name is included with your selected package, Sweet Web will register or renew the domain on your behalf. Domain names provided as part of the Sweet Web service are registered under Sweet Web's name and managed by Sweet Web on behalf of the customer, subject to the policies of the applicable domain registrar and domain registry.

Domain registration and renewal are subject to the policies and requirements of the applicable domain registrar and registry.

Where permitted by the applicable registrar and registry, customers may request that their domain be transferred to another registrar after all outstanding amounts owed to Sweet Web have been paid.

Domain registration fees and other third-party domain costs are non-refundable once incurred, except where required by applicable law.

10. Website Ownership and Intellectual Property

Unless otherwise agreed in writing, you retain ownership of the original content that you provide to Sweet Web, including your text, photographs, logos and other materials.

Sweet Web retains ownership of its website templates, designs, layouts, code, systems, software, processes, tools and other proprietary materials used to provide the Sweet Web service.

Your subscription provides you with the right to use your Sweet Web website and the services included with your package for as long as your subscription remains active and in good standing.

Cancellation or termination of your subscription does not transfer ownership of Sweet Web's templates, software, systems, code or proprietary materials to you.

11. Backups

Sweet Web makes every reasonable effort to maintain regular and reliable backups of websites and related data as part of its hosting services. Backups are intended to assist with recovery in the event of technical problems, data loss or other incidents.

While Sweet Web makes every reasonable effort to ensure that backups are complete, current and available when needed, in extremely rare circumstances a backup may be incomplete, unavailable, corrupted or otherwise unsuitable for restoring all website data.

Sweet Web is not responsible for loss of data where recovery from available backups is not possible, except where such liability cannot legally be excluded or limited under applicable law.

12. Service Availability, Features and Bugs

We make reasonable efforts to provide reliable website services. However, Sweet Web does not guarantee that websites or related services will always be uninterrupted, error-free or available.

Website functionality may be affected by software updates, security updates, third-party services, hosting infrastructure, domain providers, internet service providers or other circumstances outside our reasonable control.

We will make reasonable efforts to correct bugs or technical problems that are within our control.

We do not guarantee that every website feature will meet every specific customer preference or requirement beyond the services and features agreed upon as part of the selected package.

13. Third-Party Services

Sweet Web may rely on third-party companies and services to provide portions of the website service, including domain registration, hosting infrastructure, payment processing, email, software, plugins, APIs and other technology.

Sweet Web is not responsible for interruptions, changes, failures or losses caused by third-party services that are outside our reasonable control.

Where practical, we will make reasonable efforts to assist with issues involving third-party services used as part of your website.

14. Email Services

Where email accounts or email forwarding are included with a Sweet Web package, such services are subject to the limitations and policies of the applicable email service provider.

Sweet Web does not guarantee uninterrupted email delivery or that messages will not be delayed, rejected, filtered as spam or otherwise affected by third-party email systems.

Customers are responsible for maintaining appropriate passwords and security for email accounts provided to them.

15. Search Engine Optimization

Sweet Web may implement search engine optimization techniques as part of certain packages or services.

Sweet Web does not guarantee specific search engine rankings, traffic levels, leads, sales or other results from search engine optimization or website services.

Search engine rankings and visibility may be affected by search engine algorithms, competition, third-party platforms and other factors outside Sweet Web's control.

16. Account Security

You are responsible for maintaining the security of your account, passwords and login credentials.

You are responsible for activity that occurs through your account where such activity results from your failure to maintain the security of your credentials.

17. Suspension and Termination

Sweet Web may suspend or terminate services if you fail to pay amounts that are due, materially breach these Terms, misuse the services, or engage in conduct that creates a security, legal or operational risk to Sweet Web or its customers.

Where reasonably appropriate, we will provide notice and an opportunity to resolve the issue before suspension or termination.

Serious misconduct, including threats, harassment or abuse directed toward Sweet Web employees, contractors or representatives, may result in immediate suspension or termination.

Termination does not eliminate payment obligations that arose before termination.

18. Changes to Services and Pricing

Sweet Web may change its services, features or pricing from time to time.

Changes to pricing for existing customers will be communicated in accordance with the customer's agreement and applicable law.

Unless otherwise agreed, changes to pricing will apply to future renewal periods and will not retroactively change amounts already paid.

19. Limitation of Liability

To the fullest extent permitted by applicable law, Sweet Web and its officers, directors, employees, contractors and service providers will not be liable for indirect, incidental, special, consequential or punitive damages arising from or relating to your website or use of the services.

Sweet Web will not be responsible for losses resulting from circumstances outside our reasonable control, including third-party hosting providers, domain registrars, payment processors, software providers, internet service interruptions, security incidents or changes made by third-party platforms.

To the fullest extent permitted by applicable law, Sweet Web's total aggregate liability arising out of or relating to the services will not exceed the total amount paid by the customer to Sweet Web for the services during the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits any liability, right or remedy that cannot legally be excluded or limited under applicable law.

20. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Sweet Web, its officers, directors, employees, contractors and service providers from claims, damages, liabilities, costs and reasonable expenses arising from your breach of these Terms, your use of the services, or content that you provide to Sweet Web where such claim results from your lack of ownership or authorization to use that content.

21. Privacy and Cookies

Sweet Web's collection, use and disclosure of personal information is governed by our Privacy Policy.

Our website may use cookies and similar technologies for purposes such as authentication, functionality, analytics and remembering user preferences.

Please refer to our Privacy Policy for additional information.

22. Links to Third-Party Websites

Our website or your Sweet Web website may contain links to third-party websites or services.

Sweet Web does not control and is not responsible for the content, privacy policies, security or practices of third-party websites or services.

You should review the applicable terms and privacy policies of third-party websites that you visit.

23. Severability

If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision will be limited or removed to the extent necessary, and the remaining provisions will continue in full force and effect.

24. Assignment

Sweet Web may assign or subcontract its rights or obligations under these Terms as part of providing the services or in connection with a business transfer or restructuring.

You may not assign or transfer your rights or obligations under these Terms without Sweet Web's prior written consent, except where permitted by applicable law.

25. Changes to These Terms

Sweet Web may update these Terms from time to time.

Changes will be posted on the Sweet Web website and, where required by law, notice will be provided to affected customers.

Changes to these Terms will not retroactively alter rights or obligations that have already accrued under an existing agreement unless permitted by applicable law.

26. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Ontario and the applicable laws of Canada.

Subject to any rights or remedies available under applicable consumer protection legislation, the parties submit to the non-exclusive jurisdiction of the courts of Ontario.

Nothing in these Terms is intended to limit, waive or exclude any rights or remedies available to a consumer under the Ontario Consumer Protection Act, 2002, or any other applicable legislation, where those rights or remedies cannot legally be limited or excluded.
